Terms of Service of szybkiefuszki.pl

These Terms of Service set out the rules for using the szybkiefuszki.pl website and the conditions for the provision of services by electronic means. The Terms are made available free of charge and in a manner that allows them to be downloaded, stored and printed. Starting to use the Service constitutes acceptance of these Terms.
1. Operator and contact details
The operator of szybkiefuszki.pl (the „Service") is a sole trader registered in Poland, NIP (tax ID) 5932653430, REGON (statistical no.) 544695015, entered in the Polish Central Register and Information on Business Activity (CEIDG). 2. Definitions
The terms used in these Terms of Service have the following meanings: – Operator – the entity running the Service, indicated in point 1; – Service – the online platform available at szybkiefuszki.pl; – User – a person who uses the Service after creating an Account; – Client – a User who publishes a job listing (a gig); – Worker – a User who offers to carry out a job; – Listing – a job or offer published in the Service; – Account – a User's individual profile in the Service; – Service Agreement – an agreement concluded directly between a Client and a Worker.
3. Nature of the Service
The Service is a platform that connects Clients with Workers and provides solely a service by electronic means consisting in making available tools for publishing listings, searching and making contact. The Operator is not a party to the Service Agreements concluded between Users, is neither an employer nor a principal of the Workers, and does not act as an intermediary in carrying out a job. The Operator does not guarantee the conclusion or the proper performance of any agreement between Users.
4. Scope of services and technical requirements
The Operator provides the following services by electronic means: maintaining an Account, publishing and browsing Listings, searching, communication between Users, and leaving reviews. Using the Service requires a device with Internet access, an up-to-date web browser that supports cookies and JavaScript, and an active e-mail address. Users are prohibited from providing content of an unlawful nature.
5. Registration and Account
Creating an Account requires providing true information and accepting these Terms. The Service may be used by persons who are at least 18 years old and have full legal capacity. One User may maintain one Account. The Operator may make available additional verification mechanisms (confirmation of an e-mail address or phone number, two-factor authentication).
6. Rules of use and prohibited content
It is prohibited to publish content that is unlawful or contrary to good morals, including offers of illegal services, misleading content, spam and third-party personal data without a legal basis, as well as to commission or offer acts prohibited by law. It is not permitted to impersonate other persons, to infringe the rights of third parties, or to abuse the Service's mechanisms, including the invitation and review systems.
7. Listings and agreements between Users
Publishing a Listing constitutes an invitation to conclude an agreement. The scope, terms, deadline and remuneration for a job are agreed by the Users between themselves. The Service Agreement is concluded directly between the Client and the Worker, and it is they who bear the rights and obligations arising from it.
8. Payments and remuneration
Using the Service, creating an Account and publishing Listings are free of charge, and the Operator takes no commission on transactions between Users. Settlements for completed jobs take place directly between the Users. Users are themselves responsible for their tax settlements and, where necessary, for fulfilling obligations related to running a business (including for assessing whether their activity requires registration of a business).
9. Reviews
A review may be left only after a collaboration that has been completed and confirmed by both parties, which serves to ensure the authenticity of reviews. Reviews should be reliable and consistent with the facts. The Operator may remove reviews that breach these Terms or the law; the User to whom a review relates may respond to it.
10. Liability
To the extent permitted by law, the Operator is not liable for the quality, timeliness, legality or safety of the jobs carried out by Users, nor for the content they publish. The Operator makes every effort to ensure that the Service operates without interruption, but does not guarantee its continuous availability. The above limitations neither exclude nor limit the Operator's liability to the extent that this is impermissible in relation to consumers.
11. Moderation and reporting content
Anyone may report to the Operator content deemed unlawful or in breach of these Terms at kontakt@szybkiefuszki.pl, indicating what the report concerns and the reasons for it. The Operator examines reports and may, among other things, remove the content, restrict its visibility or block the Account, informing of the decision taken and its reasons. A User may appeal against a moderation decision by contacting the Operator. Contact point address: kontakt@szybkiefuszki.pl.
12. Suspension and blocking of an Account
In the event of a breach of these Terms or the law, the Operator may suspend or block an Account. The Operator informs the User of any suspension or blocking together with the reasons, unless the law provides otherwise. The User has the right of appeal (complaint) in accordance with point 13.
13. Complaints
Complaints concerning the services provided by the Operator (including the availability of the Service, the operation of the Account or moderation decisions) may be submitted to kontakt@szybkiefuszki.pl. A complaint should contain details enabling contact and a description of the objections. The Operator examines the complaint within 14 days and informs of the manner of its resolution.
14. Right of withdrawal (consumer)
A consumer who has concluded with the Operator an agreement for the provision of a service by electronic means may withdraw from it within 14 days without giving any reason, by submitting a statement to kontakt@szybkiefuszki.pl (the statutory model withdrawal form may be used). The right of withdrawal does not apply where the service has been fully performed with the consumer's express consent and after the consumer has been informed of the loss of that right. The foregoing applies to the agreement with the Operator; the Service Agreements between Users constitute separate legal relationships.
15. Out-of-court dispute resolution
A consumer may use out-of-court methods of handling complaints and pursuing claims, including the European Commission's ODR platform available at https://ec.europa.eu/consumers/odr and the assistance of municipal and district consumer ombudsmen. Information on consumer rights is available, among other places, on the website of the Office of Competition and Consumer Protection: https://uokik.gov.pl.
16. Intellectual property
By publishing content (including Listing descriptions and photos), the User declares that they hold the rights to it and grants the Operator a free, non-exclusive licence to present it in the Service to the extent necessary to provide the service. The rights to the Service, its software, logo and brand belong to the Operator and are subject to legal protection.
17. Changes to the Terms
The Operator may amend these Terms for important reasons, such as changes in the law, changes in the scope of the services provided, or security considerations. The Operator gives appropriate advance notice of any changes by publishing the new version in the Service and, where necessary, by notifying Users. Non-acceptance of the changes entitles the User to terminate the agreement by deleting their Account.
18. Final provisions
In matters not regulated herein, Polish law applies, with respect for the mandatory provisions protecting consumers. If any provision of these Terms proves to be invalid, the remaining provisions remain in force. The rules for processing personal data are set out in the Privacy Policy.
