This Privacy Policy explains what personal data we process on the szybkiefuszki.pl website, for what purposes and on what legal basis, and what rights you have. This document has been prepared in accordance with the GDPR (Regulation (EU) 2016/679).
1. Data controller
The controller of your personal data is a sole trader registered in Poland, NIP (tax ID) 5932653430, REGON (statistical no.) 544695015, entered in the CEIDG register. The operator has not appointed a Data Protection Officer; for any matters concerning personal data please write to the email address above.
2. What data we process
We process, among other things: Account data (name, e-mail address, password in hashed form), profile data (e.g. city, description, phone number, if you provide one), the content of Listings together with photos, messages exchanged with other Users, ratings and reviews, reports, technical data (IP address, logs, device information) and data related to securing the Account (e.g. two-factor authentication).
3. Purposes and legal bases
We process data for the purpose of: – creating and operating the Account and providing the service – Article 6(1)(b) GDPR (performance of a contract); – fulfilling legal obligations, including tax and reporting obligations – Article 6(1)(c) GDPR; – ensuring security, preventing abuse, handling complaints, and establishing and pursuing claims – Article 6(1)(f) GDPR (legitimate interest); – marketing or sending a newsletter, and the use of optional cookies – Article 6(1)(a) GDPR (consent).
4. Legitimate interests
Where the basis for processing is Article 6(1)(f) GDPR, our legitimate interest is preventing abuse and fraud, ensuring the security of the Service, keeping statistics, and establishing, pursuing and defending claims.
5. Data recipients and processors
Data may be entrusted to entities processing it on our instructions, on the basis of data-processing agreements (Article 28 GDPR), in particular hosting and database providers, an e-mail provider, file-storage services and analytics tools and, where necessary, accounting and legal services. Some data (e.g. your name, the content of a Listing, and also your phone number, if you share it) is visible to other Users to the extent necessary to connect the parties.
6. Transfers outside the EEA
If we use providers located outside the European Economic Area, the transfer of data takes place only where appropriate safeguards are in place, e.g. on the basis of a European Commission adequacy decision or standard contractual clauses. A copy of the safeguards may be obtained by contacting us.
7. Retention period
We store Account data for the duration of the Account and, after its deletion, for the periods required by law (e.g. tax law) and until the expiry of the limitation periods for claims. Data processed on the basis of consent is stored until the consent is withdrawn.
8. Your rights
You have the right to access your data, to rectify it, to erase it, to restrict its processing and to data portability, as well as the right to object to processing based on a legitimate interest and the right to withdraw your consent at any time (without affecting the lawfulness of processing carried out before withdrawal). You also have the right to lodge a complaint with the President of the Personal Data Protection Office: https://uodo.gov.pl.
9. Publicly visible data
Some of the data provided in your profile and Listings (e.g. name, city, description, photos and, if you share it, your phone number) is visible to other Users. The content of messages is available to their recipients. Please exercise caution when publishing data that makes it possible to identify you.
10. Automated decisions and profiling
We may use automated solutions, e.g. sorting and presenting Listings, and mechanisms limiting abuse (rate limiting). We do not take decisions concerning you that are based solely on automated processing and that produce legal effects within the meaning of Article 22 GDPR.
11. Cookies
The Service uses cookies and similar technologies: necessary ones (including session and login, language and theme preferences) and – with your consent – optional ones (e.g. statistical). Consent to optional cookies can be managed in your browser settings or in the consent mechanism, where available.
12. Data security
We apply appropriate technical and organisational measures to protect data, including encryption of connections and storing passwords in hashed form. Nevertheless, no method of data transmission or storage is fully secure.
13. Reporting obligations (DAC7)
As an operator of a digital platform, we may be subject to reporting obligations towards the tax administration (so-called DAC7). To the extent required by law, we may collect and transfer identification data and information about the activity of sellers and workers.
14. Changes to the Policy and contact
